The Clean Water Act (CWA) establishes regulatory requirements applicable to discharges of pollutants to “waters of the U.S.” Statutory requirements include the need for discharge permits, and associated sampling and monitoring.

Permitting and Compliance Overview
Authorized by the Clean Water Act, the National Pollutant Discharge Elimination System (NPDES) program requires that industrial facilities that discharge into the waters of the United States must be permitted. The NPDES has separate permitting programs for process wastewater and storm water. Trinity's expertise in water discharge permitting includes permit application preparation, draft permit review, water sampling, and development of electronic data systems for discharge monitoring reports.
The NPDES program requires industrial facilities covered by the multi-sector storm water permit to develop and implement a storm water pollution prevention plan (SWPPP). These plans include facility-specific information (e.g., drainage maps, pollution prevention team members, potential sources of storm water pollution, etc.) as well as management, employee training, and recordkeeping practices. Trinity has developed SWPPPs for a wide variety of industrial and construction activities.
The Clean Water Act also contains provisions that require facilities that could reasonably be expected to discharge oil (or petroleum products) in harmful quantities into U.S. waters to prepare a Spill Prevention Control and Countermeasure (SPCC) Plan. SPCC Plans ensure that facilities have in place containment and other controls that would prevent oil spills or mitigate their effects. Trinity Consultants assists clients in defining the plan elements and preparing plan documentation.
Most recently EPA has promulgated rules requiring facilities that store chemicals that are listed as CWA reportable chemicals in the event of a spill and stored in quantities greater than 1,000 times the reporting threshold to determine if a CWA FRP is required.
